Public Law 107-107, SUBCHAPTER VI - - RECOVERY AUDITS, Sec. 3561 and new OMB guidance requires each executive agency that enters into contracts that exceed $500 million in a fiscal year to conduct a program to identify and recover overpayments made to contractors. The legislation provides for use of private sector recovery audit firms to be compensated on a pay-for-performance share of actual funds recovered. Furthermore any and all associated program costs may be reimbursed from the proceeds of the funds recovered.
